Terms of Service

1. Acceptance of Terms

By accessing or using SwarmSight (“the Service”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. You must be at least 18 years of age, or the age of majority in your jurisdiction, to use SwarmSight. By using the Service, you represent that you meet this requirement.

2. Description of Service

SwarmSight provides managed infrastructure for running AI swarm simulations powered by MiroFish. Users purchase time-limited bundles that include a dedicated virtual private server (VPS) and access to the simulation platform.

Available bundles:

  • 1-Day Bundle — $5 (includes up to 3 completed simulations)
  • 1-Week Bundle — $25 (includes up to 3 completed simulations)
  • 1-Month Bundle — $80 (includes up to 3 completed simulations)

Each bundle provides a dedicated compute environment for the duration of the bundle period. Only successfully completed simulations count toward the bundle limit.

3. Bring Your Own Key (BYOK) Policy

SwarmSight requires you to provide your own Large Language Model (LLM) API keys (compatible with OpenAI, Qwen, or any OpenAI-compatible endpoint). You are solely responsible for:

  • All costs incurred by your LLM provider as a result of simulations
  • Rate limits and quota management with your LLM provider
  • Ensuring your API keys remain valid and have sufficient credits
  • Any terms of service violations with your LLM provider

SwarmSight does not store your API keys after your session ends. Your API keys are injected into the simulation environment only for the duration of the simulation and are not retained persistently on our systems. SwarmSight is not liable for any charges, rate-limit errors, quota exhaustion, or API errors from your LLM provider.

4. Simulation Disclaimer

IMPORTANT: SwarmSight simulations are computational models for research and educational purposes ONLY.

Results generated by SwarmSight simulations do NOT constitute financial, investment, legal, medical, or any other form of professional advice. SwarmSight is not licensed by the Gibraltar Financial Services Commission (GFSC) or any other regulatory body to provide advisory, financial, or investment services.

Never make financial, business, medical, or other consequential decisions based solely on simulation output. Simulation results reflect the outputs of AI models and should be treated accordingly — as one input among many in any decision-making process, not as authoritative predictions or recommendations.

5. No-Refund Policy

All purchases are final. SwarmSight does not issue refunds under any circumstances, including but not limited to:

  • Insufficient API credits or API key errors on your LLM account
  • Rate limiting or quota exhaustion imposed by your LLM provider
  • Simulation failures due to third-party outages (LLM provider downtime, hosting infrastructure issues)
  • Unused bundle time remaining at the end of your bundle period
  • Dissatisfaction with simulation results or output quality
  • Failure to download results before bundle expiry

By completing a purchase, you acknowledge and accept this no-refund policy.

6. Data Handling and Deletion

All simulation data, uploaded documents, configuration files, and results are permanently and irreversibly deleted upon bundle expiry. This includes all data stored on your dedicated VPS, simulation result files, and any uploaded seed documents.

You will receive a warning email approximately 6 hours before your bundle expires. You are solely responsible for downloading all desired results before expiry. After deletion, no recovery is possible under any circumstances.

We recommend downloading all simulation results promptly after each simulation completes, rather than waiting until near bundle expiry.

7. Intellectual Property and Open Source

SwarmSight's simulation engine is powered by MiroFish, which is licensed under the GNU Affero General Public License v3.0 (AGPL-3.0). The original MiroFish source code is available at github.com/666ghj/MiroFish. Our modifications and additions to MiroFish are available upon request in compliance with the AGPL-3.0 license.

Your uploaded documents and simulation results remain your intellectual property. SwarmSight does not claim any rights to the content you upload or the results generated from your simulations.

8. Limitation of Liability

SwarmSight is provided “as is” and “as available” without warranty of any kind, express or implied. To the fullest extent permitted by applicable law, SwarmSight disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

SwarmSight is not liable for:

  • Financial or other losses arising from acting on simulation results
  • LLM API costs, errors, or service interruptions from your API provider
  • VPS downtime or performance degradation
  • Data loss resulting from bundle expiry or deletion
  • Third-party service outages (Stripe, LLM providers, hosting infrastructure)
  • Indirect, incidental, special, or consequential damages of any kind

Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid for your current active bundle.

9. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Gibraltar. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Gibraltar.
